Terms of service

These terms are the agreement between TimetableOS ("we", "us") and the studio, business or person ("you") that uses TimetableOS. By creating an account or using the service you accept them. If you accept on behalf of a business, you confirm you can bind it. Customers of a studio who sign up on a studio's page also accept the parts that apply to them, marked below.
The service
TimetableOS is hosted software for scheduling, memberships, billing, check-in, retail, marketing, payroll and reporting, with a public booking site for each studio and a portal for its members. We may improve, change or retire features, and will give reasonable notice of changes that remove something you rely on.
Your account
- Give accurate information and keep your sign-in details secret. You are responsible for what is done through your account and for the people you invite, including their permissions.
- Tell us promptly if you think an account has been used without permission.
- You must be old enough to enter a binding contract where you live.
Acceptable use
You will not use the service to break the law, to send spam or messages people have not agreed to receive, to infringe others' rights, to upload malicious code, to probe or disrupt the service, to scrape it, or to resell it without our written agreement. We may suspend an account that does.
Your data and your members
- You own the data you put into the service. You give us the right to host and process it to provide the service.
- For your members' personal data, you are the controller and we are your processor. You are responsible for having a lawful basis, for telling your members how you use their data, for the content of your waivers, forms, terms and emails, and for any consent you need to send marketing. Our privacy policy explains how we handle data.
- You can export your data while your account is active. After it closes, we keep it for a limited period and then delete it, as the privacy policy describes.
Payments
- Payments from your members are handled by a third-party payment processor. You will need to set up an account with it and accept its terms. We do not hold your funds, and we are not responsible for the processor's delays, holds or decisions.
- You are responsible for your prices, taxes, refunds, chargebacks and disputes with your members, and for complying with consumer law, including cancellation and auto-renewal rules.
- Fees for using TimetableOS, and any fee taken from payments, are those shown to you when you sign up or agree with us in writing. Unless stated otherwise they are charged in advance, are non-refundable, and exclude taxes. We will give notice before changing fees.
Messages
Where you use the service to send email, text or push messages, you confirm that you may send them, that each campaign email includes the unsubscribe link we add, and that you will honour people's choices. Carriers and providers may block or delay messages, and we do not guarantee delivery.
If you are a studio's customer
When you sign up, book, buy or sign a form on a studio's page, your contract for classes, memberships, gift cards and anything else you buy is with the studio, not with us. The studio's own terms, prices and cancellation rules apply. We provide the software the studio uses, and we are not responsible for the studio's services, safety, or how it treats you. Your account on a studio's page is for your own use.
Our property
We own the service, its software, design and brand. We give you a limited, non-exclusive, non-transferable right to use it for your business while these terms apply. Feedback you give us may be used freely to improve the service.
Availability and support
We work to keep the service available and secure, but it is provided "as is" and "as available", and we do not promise that it will be uninterrupted or error free. Keep your own copies of anything you cannot afford to lose.
Liability
Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud. Subject to that, we are not liable for indirect or consequential loss, or for lost profit, revenue, goodwill or data, and our total liability for any claim relating to the service is limited to the fees you paid us in the twelve months before the claim arose. We are not responsible for injuries or incidents at your studio, which you run and insure.
Indemnity
You will cover our reasonable costs of any claim brought by a third party, including a member or a regulator, that arises from your use of the service in breach of these terms or the law, or from the content you provide.
Ending the agreement
You can stop using the service and close your account at any time. We may suspend or end your access if you breach these terms, if you do not pay, or if we must by law, and we will tell you why where we can. Sections that by their nature should continue, such as those on liability, data and payment, continue after the agreement ends.
Changes to these terms
We may update these terms. We will change the date above and, for significant changes, tell account holders by email. If you keep using the service after a change takes effect, you accept it.
General
These terms, with the privacy policy and any order form, are the whole agreement between us. If a part is found unenforceable, the rest stays in force. You may not transfer your rights without our consent. Our failure to enforce a term is not a waiver. These terms are governed by the laws of the place where TimetableOS is established, and its courts have jurisdiction, except where the law of your country gives you the right to bring a claim at home.
